S. Ravindran v/s State of Kerala
Jairaj and Chirutha had two sons-Gopi aged 8 and Unni aged 7. His wife Chirutha had illicit relationship with Ravindran, another villager who was richer than her husband. Jairaj disliked it and obviously they had fight over this issue.
One night Ravindran along with his two friends Surendran and Shibi came to meet Chirutha. Gopi and Unni were at home. Surendran and Shibi sat outside. Accidentally Jairaj came to his home at the same time. Jairaj and Ravindran had fight and Ravindran shot him dead. One of his neighbors Anandan heard the gun shot and when he came to Jairaj’s house he saw Jairaj dying and he told Anandan that Ravindran shot him. Ravindran chopped the head of Jairaj, in order to dump the body and get away from police case. Chirutha wiped the whole place with cow dung. Both the innocent kids were the witnesses to gruesome killing.
After three days Ananadan mustered the courage to report to the police. SI P. Ramachandran started the investigation. He unearthed the dead body of Jairaj. They were charged u/s 302 of IPC and Chirutha was charged u/s 201 of IPC for wiping the evidence. Defence lawyer grilled the kids but every time they gave correct version without any fear. Sessions Court acquitted Shibi and Surendran as they had not participated in crime. But Ravindran was given life imprisonment for murder and 3 years of jail to Chirutha.
Ravindran appealed to the High Court and Supreme Court but his plea was rejected.
